EB-5 processing times continue to shorten

Under the EB-5 Reform and Integrity Act of 2022 (RIA), improving adjudication efficiency is one of the central objectives of the Act, which pairs the agency’s fee-setting authority with average processing-time goals rather than binding deadlines. In recent years U.S. Citizenship and Immigration Services (USCIS) has continued to refine its processing in order to reduce its backlog and shorten waiting times for EB-5 investors.

Between 2019 and 2022, USCIS adjudicated an average of fewer than 250 Form I-526 petitions per month; by fiscal year 2024 that figure had risen sharply to 588 per month across Form I-526 and Form I-526E. Processing of Form I-829 improved on a similar scale, averaging 533 petitions per month. Both are encouraging signs that USCIS is working through its backlog and raising the pace of adjudication.

These gains follow from clearly stated processing goals, additional dedicated staff, revised adjudication procedures drawn from practical experience, and corresponding budget adjustments. Higher filing fees and supplemental funding from Congress have given USCIS more resources to accelerate adjudication. More petitions are now being decided each month, and investor waiting times have fallen considerably.

Priority processing for petitions tied to rural projects has been especially consequential. Under the RIA, USCIS is required to give rural petitions priority in the queue, and in practice many have been adjudicated in under 12 months — well inside the 3–3.5 years that was previously typical. For investors whose priority is how quickly they reach a green card, the choice of investment area now carries real weight.

What changed in EB-5 policy in 2025

Adjudication has accelerated

According to USCIS data, 6,090 Form I-829 petitions (the petition that removes the conditions on a green card holder’s permanent resident status) were approved in fiscal year 2024, close to three times the prior year’s total. The I-829 approval rate reached 95%, indicating that the EB-5 program continues to function as a reliable route for investors and their families to settle in the United States.

Approvals of Form I-526 and Form I-526E (the petitions through which an EB-5 investor seeks the immigrant classification that leads to a conditional green card) also rose sharply in 2024, reaching 4,906 — the highest total since the onset of the COVID-19 pandemic. That trajectory was expected to continue through 2025 as USCIS implemented further measures to shorten processing times.

In practice, many such petitions have been approved in under 12 months, compared with the 3 to 3.5 years that was previously typical. What this means for investors

As the EB-5 program continues to be refined, investors and their families stand to benefit in several concrete ways. The most significant is eligibility for an unconditional green card once Form I-829 has been approved on the basis that the job-creation requirement has been met and the investment sustained as committed. A U.S. green card allows an investor to live, study, and work in any U.S. state. It also opens access for their children to one of the world’s leading education systems, including the resident tuition rates available to a permanent resident, subject to each state’s own residency rules.

The EB-5 program also carries a commercial dimension, giving investors a position in the U.S. market with a clearly defined tax framework, a transparent business environment, and the world’s largest economy. According to IIUSA, the EB-5 program had contributed more than US$54.5 billion to the U.S. economy as of June 2024. EB-5 is therefore both an immigration route and a capital commitment — one that, like any investment, must remain at risk under U.S. law and carries no assurance of return. U.S. tax residence also brings worldwide income reporting obligations, which should be reviewed with an independent tax advisor before filing.

Under current policy, a green card holder may generally apply for U.S. naturalization after 5 years of continuous residence as a lawful permanent resident, subject to the physical presence, good moral character, and other requirements USCIS applies. For families whose longer-term intention is U.S. citizenship, that is a meaningful part of the calculation.

USCIS continues to tighten its review of the source of EB-5 investment capital. Investors should expect to document the full path of their funds — financial statements, contracts for the purchase and sale of assets, business income records, tax filings, and the supporting evidence behind each. Thorough and well-ordered documentation, prepared with an independent immigration attorney, is the most effective way to reduce the likelihood of a Request for Evidence or a denial.

Project selection

The choice of EB-5 project bears directly on the outcome of a petition. Rural projects are currently adjudicated more quickly, but investors should examine each one closely to assess whether it can realistically repay invested capital and create the required number of jobs.
