  • What is the EB-1C visa?

    • EB-1C is a U.S. immigrant visa category that leads to an unconditional green card (permanent residence) for qualifying managers and senior executives.
    • It is designed for senior executives and managers who transfer from a company abroad to lead its U.S. subsidiary, branch, or affiliate.
    • Your spouse and unmarried children under 21 may receive green cards together with the main applicant.

  • Company requirements

    • The parent company abroad has the size and financial capacity to invest in the United States.
    • The U.S. subsidiary has been actively doing business for at least 1 year and has a viable business plan.
    • The companies meet the L-1A visa criteria (a qualifying parent–subsidiary relationship and a managerial position).
  • Main applicant requirements

    • Aged 18 or older, with no upper age limit.
    • Currently holds a managerial or senior executive position at the parent company abroad.
    • Has the capability and experience to run the U.S. subsidiary.
    • Satisfactory security background and medical checks.

The EB-1C application process

  1. Establish a U.S. subsidiary

    Set up the legal entity, ownership structure, and business operations in the United States.

  2. Operate the company for at least 1 year

    The U.S. subsidiary must be actively doing business, with genuine, productive operations and a growth plan.

  3. EB-1C eligibility assessment

    We assess the company's eligibility, the applicant's role, and how well the case meets EB-1C criteria.

  4. Prepare and file with USCIS

    Prepare the company and applicant documentation, and file the U.S. company's Form I-140 petition with USCIS.

  5. Consular interview or U.S. green card processing

    Depending on the case, the applicant attends a consular interview abroad or applies for adjustment of status to obtain a green card in the United States.
