EB5 Capital Regional Center Track Record

EB5 Capital Regional Center: Its Track Record in the U.S. EB-5 Immigration Program

June 14, 2024 · EB-5 · 8 min read

The EB5 Capital regional center reports that it has raised and managed more than US$1 billion of EB-5 capital across nearly 40 projects, that 13 of those projects have repaid 100% of the capital contributed by their eligible EB-5 investors, and that 100% of the EB-5 project applications it has filed have been approved to date. These are EB5 Capital’s own published figures, and the repayment record covers only projects that have reached the end of their investment term; past performance is not an indication of future results. On that record, EB5 Capital is one of the longest-established regional centers in the EB-5 industry.

More than 90% of investors pursuing U.S. residency by investment through the EB-5 program invest through a regional center rather than making a direct investment. That puts the regional center between an investor and both of the outcomes that matter most — the immigration case and the return of capital — which is why its operating history deserves close scrutiny. An experienced regional center with a documented record is one of the most important things to examine when planning the EB-5 immigration process.

EB5 Capital regional center and the U.S. EB-5 immigration program

EB5 Capital: an established regional center with a documented track record

EB5 Capital is one of the longer-established regional centers in EB-5 U.S. residency by investment. It was founded in 2008, at a time when only around 15 EB-5 regional centers were operating in the United States. The firm owns and operates 8 regional centers designated by U.S. Citizenship and Immigration Services (USCIS), covering 45 states and Washington, D.C., in support of the economic development and job creation goals of the EB-5 program. As of June 2024, EB5 Capital reported that over its first 16 years it had raised and managed more than US$1 billion for 39 completed and ongoing projects, on behalf of more than 2,000 investors from more than 75 countries; that 100% of its EB-5 project applications had been approved to date; and that 13 projects had repaid capital in full to eligible EB-5 investors. These are the firm’s own published figures, and past performance is not an indication of future results.

As demand for U.S. residency by investment through the EB-5 program has grown, EB5 Capital has become one of the more visible names in the regional center market. The firm attributes that standing to its commitment to clients, its professional standards and its willingness to innovate, and it is well known among EB-5 investors and industry partners.

EB5 Capital attributes its record to working with experienced development partners, applying strict criteria when selecting EB-5 projects, and investing in markets it considers to have strong potential. The firm says it will continue to keep investors informed of project timelines and progress, and to open long-term residency opportunities to families worldwide while delivering the economic benefits the EB-5 program was created to produce for the United States.

How IMM Group works with EB5 Capital

As an advisory firm that has worked with the EB-5 program for more than 15 years, IMM Group has partnered with EB5 Capital — one of the longer-established regional centers in the market — since the first projects for which EB5 Capital raised and managed EB-5 capital.

Both firms work toward the same objective: helping EB-5 investor families obtain unconditional green cards, settle successfully in the United States, and recover the capital they committed to their EB-5 investment. To date, IMM Group has supported many investors and their families in obtaining a U.S. green card and in receiving repayment of their capital through EB-5 projects sponsored by the EB5 Capital regional center. Each of those projects went through detailed vetting and due diligence intended to manage the risks investors take on, but EB-5 capital must by law remain at risk for the duration of the investment, so neither repayment nor the outcome of an immigration petition is certain.

EB-5 projects from the EB5 Capital regional center that IMM Group has presented to clients include:

  • JF6 – San Jose Marriott Hotels

JF6 project: San Jose Marriott Hotels, California

  • JF14 – Portland Hilton Canopy

  • JF22 – NYC Ritz-Carlton

JF37 project: Thunder Ridge rural EB-5 development

Recent USCIS approvals for the EB5 Capital regional center’s projects and investors

In the months before this article was published in June 2024, EB5 Capital projects received a series of Form I-956F approvals from USCIS, confirming that the investments, as presented in those filings, meet the requirements of the EB-5 program. Over the same period, investors in EB5 Capital projects received Form I-526E approvals — the step that allows an investor to apply for an immigrant visa through the U.S. Department of State, or to adjust status with USCIS, and so become a conditional permanent resident — and Form I-829 approvals, which remove the conditions on that green card. USCIS states that designating a regional center or approving its project filings is not an endorsement of the investment itself; these approvals therefore speak to the firm’s experience in preparing project filings and raising EB-5 capital, and to its stated commitment to bringing well-prepared EB-5 projects to investor families, rather than to the merits of any individual investment.

Working to a long-term plan, EB5 Capital says it continues to source and develop new projects, giving investor families a wider range of options as they pursue U.S. residency.

Alongside the choice of regional center and project, investors should also choose an established immigration advisory firm to help prepare the case as thoroughly as possible and to support the family throughout the EB-5 process.
