Whisky Hotel Hollywood: how this EB-5 project is structured to address green card and capital risk
The Whisky Hotel project has received approval of its Form I-956F from U.S. Citizenship and Immigration Services (USCIS), which confirms the project’s standing under the EB-5 immigrant investor program and its compliance with the program’s requirements. Under USCIS policy, an approved Form I-956F is binding in the adjudication of the investor petitions filed in the same offering, subject to the exceptions USCIS applies. The project is also one of the few EB-5 offerings that combines two advantages: it sits within a Targeted Employment Area (TEA), which means the minimum investment is US$800,000 rather than the standard US$1,050,000 — the amounts set by the EB-5 Reform and Integrity Act of 2022 and scheduled to be adjusted for inflation from January 1, 2027 — and it holds a prime location in one of the leading entertainment districts in the United States.
Unlike most EB-5 projects, which are still in planning or under construction, the Whisky Hotel has now opened and is operating. A buffer of this size supports the job-creation requirement when an investor later files Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status, to remove the conditions on a U.S. green card. Each investor’s outcome still depends on their own petition and on USCIS adjudication.
The security behind the EB-5 loan is a further point of difference. On the sponsor’s figures, the appraised value of the project now exceeds the combined bank and EB-5 debt, and the EB-5 loan is a small share of the capital stack — 27%, or approximately US$16.1 million. That loan is secured by a pledge of the ownership interests in the Whisky Hotel, a completed and operating asset in the heart of Hollywood, with a separate property owned personally by Adolfo Suaya pledged as additional collateral. As with every EB-5 investment, however, the capital must remain at risk under U.S. law, and neither repayment nor a particular immigration outcome is guaranteed.
Taken together, these features make the Whisky Hotel a project worth close review by EB-5 investors who weigh a project’s security structure and stage of completion alongside their family’s long-term plans in the United States.
