The grandfathering provision of the EB-5 Reform and Integrity Act of 2022 (RIA) protects investors as follows:
- Petitions for projects in a Targeted Employment Area (TEA) — an area designated to encourage job creation — that are properly filed on or before September 30, 2026 are filed at the US$800,000 investment amount then in effect,
- And, under the grandfathering provision, continue to be adjudicated even if the Regional Center Program later lapses or its authorization is not extended.
This provision acts as a safeguard for the investment amount — a central consideration for investors in the TEA category of EB-5.
A scheduled increase in the investment amount
After September 30, 2026, the market enters a new adjustment cycle. The RIA of 2022 provides that the minimum investment amount is adjusted for the Consumer Price Index (CPI) every five years.
The first adjustment takes effect on January 1, 2027. According to projections from IIUSA, the largest EB-5 trade association in the United States, the investment amount for TEA projects could rise to close to US$1 million based on cumulative inflation.
Concurrent filing: an advantage for families with children already in the United States
Where a child is studying in the United States on an F-1 visa or working there on an H-1B or E-2, the investor can file the EB-5 petition (Form I-526E) for that child together with the application to adjust status (Form I-485).
This helps:
- Maintain lawful status in the United States throughout EB-5 adjudication.
- Avoid having to leave the United States while the EB-5 petition is pending, even if an earlier H-1B, F-1 or other visa has expired.
Shorter wait times through set-aside visas for rural projects
Beyond the lower capital requirement and the residency procedure, the present moment is also a strategic opportunity to take advantage of faster processing.
Under the RIA of 2022, 30% of all EB-5 visas are set aside for three groups:
- Projects in rural areas,
- High-unemployment areas,
- Infrastructure projects.
Rural projects benefit the most, given the dedicated visa allocation and adjudication times that are considerably shorter than for conventional projects.

A scarcer field of EB-5 projects works in the investor’s favor
The U.S. commercial real estate market is facing a debt “maturity wall” of roughly US$1 trillion across 2024–2025. Against that backdrop, weaker projects — those relying too heavily on EB-5 capital or lacking a solid financial base — are unlikely to survive rising capital costs and debt pressure.
Established regional centers such as CanAm and EB5 Capital apply demanding due diligence standards, including the following:
- Screening out dependent projects. A project that cannot stand on its own and can proceed only with EB-5 capital is ruled out.
- A sound capital structure. The developer is required to contribute 25%–30% in actual equity. This financial cushion obliges the developer to share risk alongside the EB-5 investors.
- Resilience under downside scenarios. The project must show that it can still repay capital under adverse conditions: falling revenue, rising costs, interest rate volatility. This is what helps protect the investment in an uncertain economic environment.
Points to weigh when selecting a rural project
The RIA of 2022 gives rural projects substantial advantages, from faster adjudication to a dedicated visa allocation. That has made rural an attractive category and drawn a large volume of investors.
A sound rural project meets the immigration criteria and also has an independent, durable business model strong enough to stand without EB-5 capital. Selecting a rural project is therefore not simply a matter of “picking whichever one is adjudicated fastest” — it means choosing a project that can hold up over the long term, which is what supports both the return of capital and the green card outcome.

A mixed-use condominium complex in the heart of Breckenridge ski resort: a promising multi-purpose resort development
The project is a multi-purpose resort complex (hotel, condominiums, and villas) located at the base of Peak 8 in the Breckenridge ski resort, Colorado.
Growth drivers:
- Exclusive scarcity: Breckenridge is one of North America’s leading ski destinations. This is the last developable land at the base of Peak 8, which the developer spent 30 years assembling.
- High liquidity: “Ski-in/Ski-out” real estate always has extremely limited supply. The clearest proof of demand is that 50% of the villa lots in Subdivision 6 sold during the infrastructure phase alone.
Protection mechanism
- Support for the green card requirement: The project is projected to create 22 jobs per investor, more than twice the minimum required by U.S. Citizenship and Immigration Services (USCIS). This projected job surplus provides a larger cushion toward meeting the job-creation requirement for permanent green cards.
- Capital protection features: Developer Breckenridge Grand Vacations has led the local market for 40 years, with a reported US$1.3 billion in historical revenue and multiple successfully operating projects in the area. EB-5 capital is raised and managed by EB5 Capital, an established regional center.
- Priority processing: The project is in a rural area, which benefits from priority processing and set-aside visa quotas.

360 Broadband rural internet infrastructure: An essential connectivity project funded by the U.S. government
The project is a plan to build and expand high-speed fiber internet infrastructure in Fannin County, Texas, providing essential service to nearly 15,000 households and businesses in an area that is currently underserved.
Growth drivers:
- Essential and urgent demand: Internet is an indispensable utility in modern life. The project targets a niche market in a rural area with limited competition but enormous demand, where existing infrastructure has not kept pace with growth.
- Established operating platform: The developer, 360 Broadband, is not a new entrant but the result of a merger between two long-established providers (360 Communications and 903 Broadband). The company already has infrastructure, an operating team, and more than 15,700 existing customers, generating stable cash flow from day one.
Protection mechanisms:
- Support for the green card requirement: The project has received a US$52.5 million non-repayable grant from the government (through Texas’s BOOT II program). Direct government funding helps support completion of construction and creation of enough jobs to meet USCIS requirements.
- Capital protection features: The project is raised and managed by CanAm, a leading regional center with a long EB-5 track record and a reported US$2.5 billion in loan capital repaid to investors. In particular, the EB-5 loan is backed by a repayment guarantee from Mark Fischer, CEO of Fischer Industries.
- Priority processing: The project is in a rural area, so investors benefit from priority processing and the 20% set-aside visa quota, which can significantly shorten the time to receive a green card compared with other areas.
