Policy context: two paths, two philosophies

On September 19, 2025, President Donald Trump signed an executive order establishing the Trump Gold Card program, allowing foreign nationals or companies to obtain U.S. permanent residence through a “financial contribution” of US$1 million to US$2 million. It has been read as a far-reaching reform, one that treats residency as an asset that can be purchased.

The EB-5 program, enacted by Congress in 1990, continues to serve as one of the more stable, transparent, and workable residency pathways available to families worldwide. To date, thousands of families have used EB-5 to build a settled life in the United States and to open education and career opportunities for the next generation.

The question is whether the Trump Gold Card is a reliable shortcut, or whether EB-5 remains the more durable and dependable long-term strategy.

Legal basis: executive order or act of Congress?

The fundamental difference between the two programs lies in their legal framework:

The Trump Gold Card was created by executive order, issued by the president without congressional approval. This is a lawful instrument within the U.S. political system, but it is also among the least durable: a later administration can amend or rescind it without a legislative vote, and federal courts can enjoin an order that is found to exceed executive authority or to conflict with existing law.

EB-5, by contrast, is authorized and governed by the Immigration and Nationality Act (INA), with a transparent amendment process and congressional oversight. Most recently, the EB-5 Reform and Integrity Act of 2022 (RIA) reset the program’s legal framework and added a grandfather clause under which investors who file on or before September 30, 2026, keep their entitlements under the law then in force, notwithstanding later changes.

Assessment: the Trump Gold Card rests on a legal foundation that a future administration or a court could unwind, and the order provides no mechanism to protect investors if the program is withdrawn. EB-5, by contrast, sits on a statutory framework that has been tested for more than 30 years.

Investment amount and return of capital: “contribution” vs. “investment”

The Trump Gold Card requires a non-refundable contribution:

  • Individuals: US$1 million.
  • Companies: US$2 million to sponsor an employee.
  • Platinum Card: US$5 million, with a stated tax benefit — reportedly an exemption from U.S. tax on worldwide income for holders who spend fewer than 270 days a year in the United States.

There is no job-creation requirement and no mechanism for return of capital.

EB-5 requires an at-risk investment:

  • US$800,000 for an investment in a Targeted Employment Area (TEA) — an amount preserved through September 30, 2026.
  • The capital is deployed into a real project, with the prospect of a return of capital.
  • The investment must create at least 10 full-time jobs for U.S. citizens or permanent residents.

Assessment: in substance, the Trump Gold Card works like a purchase of residency, whereas EB-5 is an investment intended to deliver real value to the U.S. economy and, through the prospect of a return of capital, to the investor as well.

Processing times and residency rights

The Trump Gold Card is designed for fast adjudication — projected at a few months for applications that clear security vetting. That timeline has yet to be tested in practice, however, and depends on how the executive agencies exercise their discretion.

EB-5 processing averages 1–2 years. Since the RIA in 2022, though, investors lawfully present in the United States have been able to file Form I-526E and Form I-485 concurrently — seeking a conditional green card while adjusting status, which helps them hold lawful status while the case is pending.

Assessment: on processing speed alone, the Trump Gold Card has the edge. EB-5, on the other hand, permits concurrent filing, which suits investors who are already in the United States on a student or work visa and need to maintain lawful status.

Risk and the ability to seek redress

One core difference stands out:

  • Trump Gold Card: under the executive order, an investor cannot sue the government if an application is refused or the program is terminated. The contribution could be lost in full if the order is struck down, and the order sets out no mechanism to protect it.
  • EB-5: an investor has the right to seek administrative review and to litigate if USCIS misapplies the law or delays a case unreasonably. Petitions filed on or before September 30, 2026, are also protected by the grandfather clause.

Assessment: the Trump Gold Card carries substantial legal risk, particularly in a volatile U.S. political climate. EB-5 rests on markedly stronger legal safeguards.

  • Suited to global HNWIs with strong financial capacity who are less concerned about return of capital.
  • Appropriate for those who want a fast, low-condition, low-paperwork solution and accept high legal risk.
  • Attractive to individuals focused on international tax optimization (Platinum Card).

EB-5

  • Suited to families with a clear, long-term plan to settle in the United States who want to preserve capital and rely on a durable legal framework.
  • Particularly appropriate for families with children studying in the United States, or business owners looking to expand their presence there.
