The EB-5 Grandfather Clause: Key Legal Protection for Investors Who File by September 30, 2026
January 26, 2026 · EB-5 · 12 min read
In a U.S. immigration policy environment that keeps shifting under political and budgetary pressure, grandfathering, often called the EB-5 grandfather clause, is a mechanism that protects the core interests of EB-5 investors. Understanding how grandfathering works, and acting on it correctly, not only helps reduce legal risk but also gives your whole family long-term peace of mind.

Grandfathering: key legal protection for EB-5 investors who file by September 30, 2026
What is EB-5 grandfathering? Clearing up common misconceptions
In the EB-5 program, grandfathering means an investor’s right to have their petition continue to be adjudicated under the law in effect at the time of filing, even if the EB-5 program is later changed, interrupted, or amended.
Specifically:
- When an EB-5 petition (Form I-526E) is properly filed on or before September 30, 2026,
- that petition continues to be adjudicated through to a final decision.
It is not affected by:
- The expiration of the EB-5 Regional Center Program;
- Amendments to EB-5 law;
- Or changes in immigration policy after the filing date.
Grandfathering is not a promise made by a consulting firm; it is a protection written into U.S. federal law.
Where does grandfathering come from, and where is it set out in EB-5 law?
The grandfathering mechanism is expressly set out in the EB-5 Reform and Integrity Act of 2022 (RIA), the law that comprehensively overhauled the EB-5 program.
The RIA was passed by the U.S. Congress and became law on March 15, 2022, with the aims of:
- Strengthening transparency and oversight of the EB-5 program;
- Protecting the lawful interests of investors;
- Preventing a repeat of the program disruptions seen in the past.
In the RIA, Congress deliberately set a grandfathering cutoff date: all EB-5 petitions filed on or before September 30, 2026 are eligible for grandfathering protection.
This date is written directly into the statute; it does not depend on interpretation or internal policy.
Legal effect and the specific rights protected
Legal effect:
- Grandfathering takes effect directly under federal law;
It applies petition by petition, regardless of:
- Whether or not the EB-5 project is still moving forward;
- Whether or not the EB-5 Regional Center Program is reauthorized.
Rights protected: for investors who file on time, grandfathering means that:
- The petition continues to be adjudicated under the legal framework in effect at the time of filing;
- The investor is not required to refile because the law changed;
- The petition is not invalidated if the EB-5 program is disrupted in the future.
Adjudicating these petitions and giving effect to these rights falls to U.S. Citizenship and Immigration Services (USCIS), the federal agency responsible for administering and adjudicating U.S. immigration petitions.
Who created grandfathering, who adjudicates it, and how robust is it?
- Created by: the U.S. Congress (through the RIA).
- Implemented and adjudicated by: USCIS.
How robust it is:
- Significantly stronger than any protection available to EB-5 investors before 2022;
- Designed to remain in effect even if the EB-5 Regional Center Program changes or is interrupted.
For this reason, grandfathering is regarded as the most important legal safeguard for EB-5 investors today.
Could the grandfathering date be extended? What you need to know
At the time of writing (January 2026):
- Within the EB-5 community, there are ongoing discussions and policy advocacy efforts to extend the grandfathering date so that it aligns with the EB-5 program’s reauthorization timeline;
- However, no new legislation has been enacted to replace or extend the September 30, 2026 date.
Therefore:
- Under current law, the only certain grandfathering date remains September 30, 2026;
- IMM Group advises clients not to base their decisions on expectations that have not yet been written into law.
How long does it take to prepare an EB-5 petition, and why shouldn’t you rush it?
In practice:
Preparing a complete and well-documented EB-5 petition typically takes 2.5–4 months, depending on:
- Your family’s financial structure;
- The source of the investment funds;
- How organized and complete your supporting documents are.
Preparing a petition in any of the following circumstances:
- Under time pressure;
- Without a clear strategy for presenting and explaining your case;
- Or in a race against the clock.
Any of these can increase legal risk and prolong adjudication. EB-5 is a major decision that deserves careful, structured preparation and a clear roadmap, not a last-minute rush to meet a deadline.
