Under that proposal, the minimum investment would rise to US$5 million from the EB-5 level of US$800,000, which would directly affect investors planning to obtain a U.S. green card through EB-5. The proposal could open a new residency-by-investment option, but its feasibility and timing still needed careful assessment, and implementation could take several months if it were approved. Investors working toward a U.S. green card may therefore want to weigh their options while the current EB-5 investment level still applies. Rural EB-5 set-aside visas account for 20% of the 10,000 EB-5 immigrant visas available each year — one of three set-aside categories created by the EB-5 Reform and Integrity Act of 2022 (RIA) — and investor interest in them continues to climb. USCIS has also shortened processing from 3 years to about 12 months for this category, which has sharpened competition and left rural EB-5 allocations in short supply.

Why investors are drawn to rural EB-5 projects

1. Priority processing

Rural EB-5 petitions are typically adjudicated in about 12 months, materially faster than petitions filed in other categories, where processing can run to 3 years. Processing times are published by USCIS and change from quarter to quarter; they are not a commitment.

2. A dedicated set-aside visa allocation

The U.S. government reserves 20% of the 10,000 EB-5 immigrant visas issued each year for rural projects. That dedicated allocation gives investors a route around the backlog in the unreserved category, which matters most to applicants whose country of chargeability is oversubscribed.

3. Rural EB-5 projects create jobs above the program minimum

Rural projects frequently create well above the minimum of 10 jobs per investor that the EB-5 program requires, which strengthens the job-creation evidence behind each petition.

4. Underwriting and cash flow

  • Valuations and projected income: rural EB-5 projects are often acquired at competitive valuations, and sponsors typically underwrite them to produce stable pre-tax operating income. Projections are estimates, not assurances.
  • Cash flow: the business models are structured to generate steady revenue and to support repayment of the EB-5 capital.

5. Sponsor oversight and structural safeguards

Many rural projects are sponsored by established regional centers — EB5 Capital and CanAm Enterprises among them — which typically means institutional-grade reporting, third-party fund administration, and documented oversight of how EB-5 capital is deployed.

6. Limited supply of qualifying projects

Very few projects clear every hurdle at once: a genuine rural location, documentation that meets EB-5 requirements, and a capital structure with a defined mechanism for repaying the EB-5 loan on a credible route to a U.S. green card. Investors who secure one of these allocations gain the benefit of priority adjudication and, in practice, a shorter route to U.S. permanent residence.

What is making rural EB-5 allocations so scarce

Two things are happening at once: the supply of projects that genuinely qualify as rural is limited, and investor demand for rural EB-5 allocations keeps rising.

1. Rising investor demand

International investors — particularly from countries where the unreserved EB-5 category is oversubscribed — are steering toward rural projects for the faster adjudication and the earlier route to U.S. residence. Allocations in those projects fill quickly as a result.

2. Few projects qualify as rural

Not every EB-5 project can claim rural status. Under the statute, a rural area is any area outside a metropolitan statistical area as designated by the Office of Management and Budget, and outside the outer boundary of any city or town with a population of 20,000 or more according to the most recent decennial census. That narrows the pool of qualifying projects considerably.

3. A higher evidentiary bar at USCIS

A rural EB-5 project must show that it will create at least 10 jobs for U.S. workers per investor, as the program requires. Beyond that, the standards USCIS applies to financial transparency and to the viability of the business plan have become more exacting.

Where the opportunity stands for EB-5 investors today

1. How to make the most of a rural EB-5 allocation

  • File early: have your funds and your source-of-funds documentation ready, so that an allocation is not lost while paperwork is still being assembled.
  • Choose an established regional center: sponsors such as EB5 Capital and CanAm Enterprises have long track records of EB-5 petition approvals. Ask each sponsor for its documented record of capital repayment on completed projects. Past repayment is not an indication of future results, and EB-5 capital must remain at risk under U.S. law.
  • Consider concurrent filing: investors already in the United States in valid nonimmigrant status, such as F-1 or H-1B, may be able to file Form I-526E and Form I-485 together, which can shorten the time to a green card. Concurrent filing is available only when an immigrant visa number is immediately available — that is, when your category and country of chargeability are current in the Department of State Visa Bulletin — and it does not remove the need to maintain lawful status while the application is pending.

2. Rural EB-5 projects currently receiving priority adjudication

  • EB5 Capital is an experienced regional center with a record of EB-5 project approvals and close oversight of how EB-5 capital is deployed.
  • An established, experienced developer has provided a completion guaranty — a contractual undertaking to finish construction — together with a guaranty of the EB-5 loan under the project documents. Neither instrument guarantees that EB-5 capital will be repaid.
  • Minimum investment: US$800,000, the reduced amount that applies to projects in a targeted employment area (TEA), including rural areas. The standard EB-5 investment amount is US$1,050,000.
