EB-5 Approval Rate and Filing Statistics from AIIA

The latest U.S. Citizenship and Immigration Services (USCIS) data, current through July 31, 2025 and obtained by the American Immigrant Investor Alliance (AIIA), gives a realistic picture of how EB-5 petitions have been processed since the EB-5 Reform and Integrity Act (RIA) took effect in 2022.

EB-5 statistics at a glance (April 2022 – July 31, 2025)
The figures show a significant rise in new EB-5 filings after the RIA reauthorized the Regional Center Program, and adjudication metrics, including the EB-5 approval rate, point to greater consistency in the post-reform period:
- Total Form I-526/I-526E petitions filed: 13,520
- Total petitions approved: 3,442
- Total petitions denied: 113
Among petitions that have been adjudicated, the estimated approval rate is around 96%, and the majority of those adjudications involved rural projects.
This figure should be read in context: it reflects only the outcomes of petitions already processed, not all pending cases, and it is not a guarantee of success for any individual case. The outcome of an EB-5 petition still depends on the quality of its source of funds documentation, the project itself, and the petition’s legal compliance.
The data also indicates that USCIS is adjudicating petitions with greater consistency than before 2022. That makes the process more predictable for investors, although risk is inherent in every investment migration program.
Vietnam in the global EB-5 picture
According to the data, investors from Vietnam filed 395 EB-5 petitions during the period tracked. Of these:
- 271 petitions for projects in high-unemployment Targeted Employment Areas (TEAs)
- 105 petitions for rural projects
- 19 petitions in other categories
Among petitions that have been adjudicated:
- 89 petitions approved
- 1 petition denied
Notably, more than half of the approved petitions from Vietnam were in the rural category (50 of 89). This share most likely reflects the RIA’s priority processing for rural petitions, which tends to bring rural cases to a decision sooner and therefore makes them more heavily represented among petitions that have already been decided. However, the data should not be read as “rural is the safer choice.” Rural classification affects how and when a petition is processed; it is not a direct measure of project quality. A rural project with a weak structure can still carry more risk than a non-rural project with solid fundamentals.
Compared with larger markets such as China and India, Vietnam’s filing volume remains relatively modest. For now, this means Vietnam faces less pressure from visa backlogs, and because filing volumes are not yet high, petitions from Vietnam may move through the process more quickly.

The current figures suggest EB-5 is in a relatively stable phase: adjudication is more consistent, the rural category receives priority processing, and Vietnam does not yet face major backlog pressure.
These factors reflect conditions at a point in time, not a permanent state. EB-5 remains directly affected by immigration policy and market cycles, so today’s trends are not a guarantee of tomorrow’s.
What stands out in this period is that investors have more real-world data to draw on when weighing the program, from processing speed and visa allocation by category to filing volumes from each market. This allows investors to approach EB-5 in a more calculated and strategic way.
Timing, therefore, is not only a matter of “favorable market conditions” but also of the current policy framework, particularly the RIA’s grandfathering provision, which sets a clear time limit for petitions filed in this period.
The window before the grandfathering deadline
Under the RIA, the EB-5 Regional Center Program is currently authorized through September 30, 2027, but only petitions filed on or before September 30, 2026 are grandfathered: they will continue to be adjudicated under the current legal framework even if the program lapses or is not reauthorized.
That means petitions filed after that date could be affected by future policy changes — a factor that is inherently hard to predict in immigration programs.
In the current context, this is seen as a favorable time to consider filing.
