So what exactly is concurrent filing, and what does it offer you as an investor? This article answers the questions that come up most often about concurrent filing, and sets out what to keep in mind before you use it, so that you and your family can weigh the option carefully as part of your U.S. immigration plan.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/immgroup.com\/wp-content\/uploads\/2024\/08\/Nop-ho-so-dong-thoi-Concurrent-Filing-khi-xin-visa-dinh-cu-My-EB-5-la-gi.webp\" alt=\"EB-5 concurrent filing explained: an investor files the EB-5 petition and the adjustment of status application together\"><\/p>\n<h2><strong>What is concurrent filing?<\/strong><\/h2>\n<p>In the past, an applicant who was in the United States on a nonimmigrant visa could not apply to adjust status until the immigrant petition had been approved. Once the nonimmigrant visa expired, the applicant had to leave the country and wait until the immigrant visa was issued. That has changed. U.S. Citizenship and Immigration Services (USCIS) now permits concurrent filing, which means you may file Form I-485, the application to adjust status, at the same time as the immigrant petition, or while that petition is still pending. Even if your earlier nonimmigrant visa has expired, you are entitled to remain lawfully in the United States until the immigrant visa is issued.<\/p>\n<p>For the EB-5 program, the EB-5 Reform and Integrity Act of 2022 (RIA) allows EB-5 investors to file Form I-526 or Form I-526E, the petition for a conditional green card, together with Form I-485, the application to adjust status to permanent resident. Two conditions apply. First, concurrent filing is available only to investors already living in the United States on a nonimmigrant visa such as F-1, E-2, L-1 or H-1B. Second, an immigrant visa must be immediately available to you when you file, which means your EB-5 category must be current for your country of chargeability on the Department of State Visa Bulletin, so it is worth checking the Visa Bulletin before you plan around this route. Where both conditions are met, concurrent filing shortens the time it takes to reach a green card: under the earlier practice, Form I-485 could be filed only after the I-526 petition had been approved, and the investor then had to wait roughly another 6\u20139 months for the I-485 to be adjudicated, whereas a concurrently filed I-485 is already on file by the time the petition is approved.<\/p>\n<p>Once you file concurrently, your EB-5 case carries \u201cI-485 pending\u201d status, and that pending I-485 allows you to stay lawfully in the United States even if your F-1, E-2 or other nonimmigrant visa expires. Keep in mind that while the I-526 or I-526E petition is still awaiting approval, you do not yet hold the rights and benefits of a permanent resident. Nor can you simply leave the country: if you depart while your I-485 is pending and you do not hold an Advance Parole document, USCIS treats the I-485 application as abandoned.<\/p>\n<h2><strong>Benefits of filing your EB-5 case concurrently<\/strong><\/h2>\n<p>To work and travel while your I-485 is pending, you may file Form I-765, Application for Employment Authorization, and Form I-131, Application for Travel Document, alongside Form I-485. Filed together and approved, the two are issued as a single card, widely known as the Combo Card. The Employment Authorization Document (EAD) lets you work for any employer anywhere in the United States, and the Advance Parole lets you leave and return without that departure being treated as abandonment of your I-485. Between them, the two documents cover the practical ground of working and travelling, though they do not make you a permanent resident and do not carry a permanent resident&#8217;s benefits. Advance Parole also does not settle every travel question, so speak with an independent immigration attorney before you plan a trip. Processing time for the Combo Card is <strong>around 12 months<\/strong>.<\/p>\n<p>In short, filing Form I-485 and the Combo Card applications alongside Form I-526 or Form I-526E lets EB-5 investors begin working and travelling while the case is still pending, well before the <a href=\"https:\/\/immgroup.com\/my\/eb5\/the-xanh-my-la-gi-nhung-quyen-loi-nhan-duoc-khi-so-huu-the-xanh-my\/\">U.S. green card<\/a> and permanent resident status themselves are approved.<\/p>\n<p>One point deserves particular attention: concurrent filing <strong>is available only while the applicant is physically in the United States, and only to the applicant who files the EB-5 petition<\/strong>. Dependent children included in the case cannot file concurrently in their own right, even if they are already in the United States.
