The Thunder Ridge EB-5 Project: Rural, Already Operating, and Prioritized by Law for the U.S. Green Card<\/h1>\n

A U.S. green card through investment. The Thunder Ridge EB-5 project, a rural project in the Missouri Ozarks, is reported by its regional center to be already operating, which bears on two risks EB-5 investors examine closely: construction completion and job creation. U.S. law still requires EB-5 capital to remain at risk, and investors can lose some or all of it.<\/p>\n

A rural EB-5 project<\/strong> \u2014 one located outside a metropolitan statistical area and outside the outer boundary of any city or town with a population of 20,000 or more, as measured by the most recent decennial census \u2014 qualifies for priority processing of investor petitions, because the EB-5 Reform and Integrity Act of 2022 requires USCIS to prioritize them. When such a project is also already operating, several of the risks that typically arise during development are reduced. That combination is uncommon, and worth the attention of EB-5 investors.<\/p>\n

For anyone entering the EB-5 immigrant investor program<\/a>, selecting a sound EB-5 project is one of the decisive steps. Because of the advantages created by the program’s current rules, rural EB-5 projects are being actively marketed and are attracting considerable interest from EB-5 investors.<\/p>\n

Rural EB-5 projects, however, often carry risks that can emerge during development. Those risks affect the construction schedule and the project’s ability to reach completion, and in turn both the prospect of an unconditional U.S. green card<\/a> and the repayment of investor capital. A rural EB-5 project developed by an experienced regional center, and especially one that is already operating, is therefore an uncommon profile that merits a close look.<\/p>\n

\"Thunder<\/p>\n

The Thunder Ridge rural EB-5 project<\/strong><\/h2>\n

Set in the Ozark Mountains of southern Missouri, Thunder Ridge<\/a> is a project to expand and upgrade an outdoor amphitheater and entertainment complex with a seating capacity of up to 20,000. Thunder Ridge \u2013 Nature’s Arena sits within the well-known Big Cedar Lodge resort, which the project materials describe as drawing roughly 7.5 million visits a year.<\/p>\n

The project meets the EB-5 program’s definition of a rural area because it lies in a sparsely populated mountain and forest area. Unlike most rural locations, however, the setting is a wilderness conservation area. That gives the project a distinct character and, for EB-5 investors, bears on both the immigration petition and the investment itself.<\/p>\n

Completion had been expected in July 2024, but the venue began hosting events before then: it held its opening event on May 25, 2024, and a series of large-scale events had already been booked for the months that followed, an early indication of demand for the venue.<\/p>\n

Total project capitalization is US$158.9 million, of which EB-5 capital is expected to account for US$50.4 million, equivalent to 63 investors, or roughly 32%. The remaining 68% comes from the project sponsor. The EB-5 capital is managed by EB5 Capital, a long-established regional center operator that, on its own published record, has to date raised and managed more than US$1 billion across 39 EB-5 projects, 13 of which have been completed and have repaid 100% of the capital to their EB-5 investors. That record relates to earlier projects and does not indicate how this one will perform.<\/p>\n

Priority processing and access to rural set-aside visas<\/strong><\/h2>\n

Under the EB-5 Reform and Integrity Act of 2022 (RIA), enacted in March 2022, USCIS must prioritize petitions filed by investors in rural projects. Congress also reserved 20% of the annual EB-5 visa allocation for rural projects, alongside 10% for high-unemployment areas and 2% for infrastructure. The reserved visa follows from where the investment is made: the investor files Form I-526E (Immigrant Petition by Regional Center Investor), and on approval the visa is issued from that rural allocation.<\/p>\n

Because Thunder Ridge is in a rural area, an investor’s Form I-526E here goes into the priority queue, and the expectation at the time of writing was a decision on the EB-5 petition in under 12 months<\/strong>. The RIA sets processing goals, an average of 240 days for investor petitions and 120 days for petitions tied to a targeted employment area (TEA), but these are goals rather than deadlines and USCIS does not commit to a timeframe in any individual case. Check current USCIS processing times before relying on any estimate.<\/p>\n

A project already operating: what that changes for the green card petition and for the invested capital<\/strong><\/h2>\n

With most projects, EB-5 capital is raised when construction has only just begun, or even while the project is still on paper, and completion then takes two to three years on average. Thunder Ridge, by contrast, was in its final construction phase and had already held its first show, on May 25, 2024, opening a schedule of large-scale events booked in advance.<\/p>\n

According to the project’s most recent economic report, Thunder Ridge had created 569 jobs as of the end of April 2024. On the project’s completion in July 2024, the jobs recorded in that report were expected to exceed by a wide margin the minimum requirement for the project’s 63 EB-5 investors: EB-5 law requires each investor to create at least 10 full-time positions for qualifying employees, or 630 positions in total. Job creation is therefore well advanced by the time an investor files an EB-5 petition, which matters at the later removal of conditions on the green card. Job figures in EB-5 economic reports are modeled estimates rather than payroll counts.<\/p>\n

Opening the venue before formal completion tested its fit with the market and set a baseline for Thunder Ridge’s future growth. An independent appraisal commissioned for the project valued it at US$178 million as of 2026, once operations stabilize, well above the US$50.4 million of EB-5 capital, and estimated average annual pre-tax income of approximately US$15 million. On those figures, either route to repaying the EB-5 investors is open: raising new capital to replace the EB-5 loan, or repaying investors from the project’s operating cash flow. These are projections made in 2024, not realized results, and neither route is assured: U.S. law requires EB-5 capital to remain at risk, and investors can lose some or all of it.<\/p>\n

Thunder Ridge<\/strong> is an uncommon EB-5 project: it falls under the priority rules for rural areas while reducing some of the development risk that otherwise bears on the immigration petition and on the investment. What remains for the investor is due diligence on the offering documents and the choice of an established immigration advisory firm to prepare the strongest possible petition and to support the family throughout the EB-5 process<\/a>.<\/p>\n
